1. Consent to Use of Work: By participating in this grant, competition, or conference, or by submitting your material to AECT, You grant AECT the exclusive right to use, reproduce, or publish (in any manner now known or hereafter developed) for promotional, marketing, or any other lawful purpose, any research, papers, or other work You provide in connection with that grant, competition, conference, or submission (the “Work”). This includes, but is not limited to, social media, websites, and print materials, and may include publication in an AECT journal or book with a chosen AECT publisher, or any other publisher, in which event your Work will be credited to You.
2. Release of Liability: You release AECT, its board, officers, members, and anyone related directly or indirectly to AECT, from any and all liability related in any way to the use of the Work, including, but not limited to, any copyright infringement claims, trademark infringement claims, claims for defamation, invasion of the right of privacy, and violation of the right of publicity.
3. No Compensation: You acknowledge that You will not receive any compensation for the use of your Work in AECT's promotional activities or from AECT publications with or without a publishing partner.
4. Limited Intellectual Property Use & Intermediary: If one of AECT’s non-publishing related sponsors or business partners, such as NATO Allied Training Command, wishes to utilize your Work for a product or service outside of the Design & Development competition or an AECT publication, only at that time will AECT approach You with a royalty proposition for your Work with that designated sponsor or business partner. You have the right to refuse the offer, but for 10-years from the date of the offer, You are not permitted to independently approach the partner for a separate royalty or other agreement related to the Work exclusively provided to AECT.
5. Use of Your Own Research: You may use your own research that You submitted to AECT for other supportive academic works and/or additional future publications as long as that work is not substantially similar to the Work submitted to AECT.
6. Governing Law: This Agreement is deemed executed in the State of Indiana and will be interpreted and construed in accordance with the laws of the State of Indiana and the United States of America.
7. Understanding & Agreement to Terms: By submitting your Work to AECT, You are representing that You have read and agree to all of these terms. Likewise, You understand your submission of Work to AECT does not guarantee publication, acceptance, or use by AECT of that Work.
8. Enforcement of Rights. You grant AECT the exclusive right to enforce your rights in and to the Work.
9. Attorneys’ Fees. In the event that any action, suit or legal proceeding is initiated or brought to enforce any or all of the provisions of this Agreement or for its breach, the prevailing party shall be entitled to such attorneys’ fees, costs and disbursements as are deemed reasonable and proper by an arbitrator or court. In the event of an appeal of an initial decision of an arbitrator or court, the prevailing party shall be entitled to such attorneys’ fees, costs and disbursements as are deemed reasonable and proper by the appellate court(s).
